Noodle Performance Arts - Statement
These Terms and Conditions set out the basis on which Noodle Performance Arts provides classes and related services, and outline the rights and responsibilities of parents, students, and Noodle Performance Arts.
They cover important information regarding fees and payment arrangements, class schedules, attendance, cancellations, data protection, health and safety, use of images for marketing, and circumstances beyond our control.
By enrolling your child with Noodle Performance Arts, you agree to be bound by the Terms and Conditions below, which are designed to ensure clarity, fairness, and the smooth running of our classes.
Terms & Conditions
1. The personal data collected on the Noodle system will be processed in accordance with our Privacy Policy, which can be found on our website.
2. Class times and fees vary according to your Noodle area. Please contact your Noodle director for more information. Classes take place once a week during the normal academic terms of your Noodle area.
3. Methods of payment:
a. Monthly payment by card (via GoCardless)
b. Online card payment (for merchandise/ad-hoc payments via GoCardless)
c. Card payment in class (for merchandise/ad-hoc payments)
4. Fees are payable monthly and are paid automatically by Direct Debit, via Go Cardless. Your monthly payment is based on 39 weeks of classes per year, spread over 12 calendar months. This means that 12 payments are made during the year, including August. Fees are payable whether or not your child attends any/all classes during the period. No reduction in fees will be made for Bank Holidays.
5. Sibling discounts:
a. A discount of 20% is given to a sibling in the same class as a full-paying student
b. A discount of 50% is given to a second sibling in the same class as a full-paying student
c. Discounts may be given to a sibling in a different class running at the same time or on the same day. This is at the discretion of Noodle Performance Arts.
6. Absences
a. Absences are payable in full. This includes the first class of half-term, should this be missed. Please contact us regarding any exceptional circumstances.
7. Noodle Performance Arts reserves the right to exclude students from lessons at its discretion.
8. Noodle Performance Arts reserves the right to make changes to the timetable and to the teaching staff.
9. Fees are reviewed annually.
10. Noodle Performance Arts will from time to time take photographs and film footage of students during class time for use in Noodle marketing material, Noodle’s website and social media. We ask your permission for this when you register with Noodle. Should you wish to withdraw this permission, please contact your Noodle director.
11. Students participate at their own risk and parents are obliged to inform Noodle Performance Arts and its staff of any existing injuries, medical conditions or additional needs.
12. Students and parents are obliged to take care of their own belongings. Noodle Performance Arts can accept no liability for lost or damaged belongings brought to class.
13. Class cancellations:
a. In the event of severe weather, class payments will be due if the teacher reaches the venue and is able to teach the class. If the teacher is unable to reach the venue, a credit for that class will be made to your account.
b. If classes are cancelled by Noodle Performance Arts for any other reason, a credit for that class will be made to your account.
14. Parents must update Noodle Performance Arts with any changes in their contact details or address.
15. Physical contact may be necessary by members of our teaching staff in the course of lessons. If you have any concerns regarding this matter please contact Noodle HQ or your Noodle director.
16. Cancellation of membership: 30 days’ notice in writing (email and/or text/Whatsapp communication to Noodle HQ is acceptable – [email protected]) must be given to cancel your child’s place in class – PLEASE NOTE that the 30 days’ notice is for the cancellation of your direct debit, so we must have been informed of the cancellation 30 days before your next direct debit falls due. Payments will be due in your notice period, even if your child does not attend classes. Please note that any cancellations made during May-July, where the child returns to class during September-November, will incur an additional one-month charge upon their return. This is because the payment of fees during August is part of our fee calculation for the year..
17. Noodle Performance Arts is a trading name of Noodle Performance Arts South Yorkshire LLP.
18. Force Majeure: Neither Party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalised lack of availability of raw materials or energy.
